Suggestions and Proposals for the National Action Plan to Eradicate Corruption from Sri Lanka

  1. Introduction

The Commission to Investigate Allegations of Bribery or Corruption has decided to call suggestions and proposals from public sector, private sector, civil societies, media and general public to prepare National Action Plan to eradicate bribery and corruption from Sri Lanka. Submissions should be provided as follows. 

  1. Background
    1. Bribery and corruption has been a domestic, regional and international burden

    2. The Bribery Act, Assets and Liabilities Declaration Act, Prevention of Money Laundering Act are functioning domestically against corruption. Accordingly, the Commission to Investigate Allegations of Bribery or Corruption has been established under the Commission to Investigate Allegations of Bribery or Corruptions Act No.19 of 1994 as the major mechanism against corruption. This Act provides power to the Commission to Investigate Allegations of Bribery or Corruption to conduct investigations and serve charges under Bribery Act No.11 of 1954 and Declaration of Assets and Liabilities Act No.01 of 1975.

    3. Various laws, conventions and mechanisms have been established locally, regionally and internationally to curb corruption. Accordingly the United Nations Convention Against Corruption introduced in year 2003 has been an important accord signed by Sri Lanka on 15th March 2004 and ratified on 31st March 2004. Hence, Sri Lanka under Section 5(2) of the Convention is bound to establish an administrative mechanism with an appropriate legal background to fight against corruption. Therefore, the international community time to time evaluate the systems and mechanism established by the government against corruption.

    4. In terms of Article 156 “A” of the 19th Amendment to the Constitution the necessary acceptance has been granted to implement the provisions of United Nations Convention and other international conventions against corruption.

    5. The unavailability of National Action Plan in Sri Lanka has been pointed out by international evaluations on laws of Sri Lanka.

    6. Furthermore, the actions to be taken against corruption have been cited in the National Action Plan prepared under the approval of Cabinet of Ministers as per the Open Government Partnership which, Sri Lanka is a member. Therefore preparing an action plan against corruption has been a major role.

    7. Pursuant to above situation, the Cabinet of Ministers has granted approval on 24.10.2017 to prepare an Action Plan against corruption. Therefore the urgency to prepare an Action Plan to eradicate corruption is remain as a requirement.

            

  1. Suggestions and Proposals

In the above circumstances, the Commission to Investigate Allegations of Bribery or Corruption has decided to call suggestions and proposals from all parties to create National Action Plan Against Corruption. Please forward your suggestions giving attention to following core areas and any other appropriate areas accordingly.

  1. Strengthening of Commission to Investigate Allegations of Bribery or Corruption
    To enhance and strengthen institutional structure and human resources of Commission to Investigate Allegations of Bribery or Corruption 
  1. Strengthening investigations
    To strengthen investigations on bribery and corruption and obtain assistance of experts. 
  1. Strengthening prosecutions of bribery and corruption
    To expedite and strengthen prosecutions on bribery and corruption 
  1. Prevention of bribery and corruption
  1. Actions to be taken on raising awareness among children, young persons, private sector, public sector, civil societies, media and general public on preventing bribery and corruption.
  2. Educational programmes to be launched on bribery and corruption
    • Children
    • Youth
    • Adult
    • Public sector
  1. Creating of national action committee to prevent corruption with the partnership of public sector, private sector, civil societies and general public.
  1. Preventing of bribery and corruption of Public Members and raising integrity
  1. Raising integrity of judicial system and institutions related to prosecution
  1. Raising integrity of public sector to mitigate bribery and corruption within the public sector
    1. Appointing of an Integrity Officer to supervise, monitor and provide information of bribery and corruption incidents in public sector
    2. Implementing of public charter in public sector
    3. Establishment of corruption prevention committees in public institutions
  1. Preventing of bribery and corruption in private sector
  1. Preventing of bribery and corruption in public procurement and fiscal management
  1. Proposals subject to the laws to recover assets earned by bribery, corruption, money laundering and other crimes
  1. Proposals to amend laws on bribery and corruption and other related laws
  1. Proposals to protect whistle blowers
  1. Proposals subject to law to limit funding election campaigns
  1. Other
